Complaint of Over Limit Contributions and Request for Audit – Obama for America (C00431445) and Obama Victory Fund (C00451393)

Over Limit Contributions for United States Alabama, Arizona, Arkansas, Delaware, Iowa, Kansas, Kentucky, Minnesota, North Carolina, New Hampshire, New Mexico, Ohio, Rhode Island, Tennessee and Utah

 

Dear Sir or Madam:

This is a complaint pertaining to the over limit campaign contributions for Obama of America.  Members of our Political Action Committee, People United Means Action, have been reporting these exceedances and this complaint summarizes what has been reported to date and supplements it with the exceedances in the above named states.  Our primary studies are done on the Pre-General FEC Reports for Obama for America and the Obama Victory Fund.  However, this complaint also includes reports of continued violations in the Post-General FEC Reports.

The results of the Pre-General studies are reported in Table I.  In addition to what has been reported to date, this report contains an additional 71 violations and total $69,236 (Table II) bringing the total to 893 violations totaling over $1.3 million (Table I).

As another matter of concern, the FEC data obtained form the website, through a page titled “Contributions to Barack Obama by State Through 10/15/2008” totals only $416 million  while the FEC page listed an amount of $579 Million in funds.  Does that mean $163 million came from no state of the United States?

Furthermore, the Post-General over limit violations appear to be worse.  Of the 71 Pre-General exceedances in this study, 42 of the contributors were given refunds based on the Post-General Report.  However, the Post-General contributions for the same state showed 110 exceedances, totaling $100,178 (Table III).  The studies are limited to violations of a $4,600 limit, the most simple and straightforward of limits.  The Obama Campaign’s failure to comply with these limits is indicative or serious problems.  How much are they violation the limits of $2,300 per primary and general election?  Are they above the law?

The American People need an audit of the Obama for America (C00431445) and Obama Victory Fund (C00451393).  The sheer volume of transactions prohibits transparency.  We are depending on the FEC to assure compliance with fair practices.  Please audit the Obama Presidential Campaign Funds.  Thank you for your time and consideration.
